Bake Theory Terms and Conditions

Welcome to Bake Theory's website (baketheory.ca). These Terms and Conditions ("Terms") govern your access to and use of our website, including any purchases, orders, or interactions with our services. By accessing or using our website, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

We reserve the right to update these Terms at any time. Changes will be posted on our website with a revised effective date. Your continued use of the site after changes constitutes acceptance of the updated Terms.

Our website is hosted on Shopify, and certain features (e.g., payments, accounts) are subject to Shopify's terms of service.

Eligibility

You must be at least 18 years old or have the consent of a parent or guardian to use our website and place orders. We do not knowingly accept orders from children without parental involvement.

Ordering Process

  • Ordinary Orders: All orders must include a minimum of 12 bakery items. Once an order is placed and confirmed, it cannot be cancelled or refunded, as our team begins preparation immediately. All sales are final for perishable bakery goods.
  • Wholesale Orders: Require a minimum of 24 units per product. Orders can be one-time or recurring. Seasonal products are available upon request and may require additional lead time. Packaging options include individual items, multi-packs, or gift-ready packaging.
  • Catering Orders: Typically require a minimum of 12 pieces per item, with larger trays and platters available. Lead times are 3–5 business days for standard orders and 7–10 days for larger events.

For wholesale and catering orders, you must inform us within 24 hours of placing your order to make changes to the order amount, address allergy concerns, or request cancellation. Cancellations for these orders will incur an administration and raw materials charge equal to 50% of the order amount.

Custom orders (including those with dietary preferences or allergies) are tailored based on the information you provide. You are responsible for the accuracy of any health-related details (e.g., allergies) submitted. We handle such information carefully but cannot guarantee against cross-contamination or errors in user-provided data. Health-related details for bulk orders are tied to the order, not individuals.

All orders are subject to availability of ingredients and our production capacity. We may contact you if adjustments are needed.

Payment

We accept payments through Shopify Pay, which supports credit cards, debit cards, PayPal, Apple Pay, and Google Pay. All payments are processed securely via Shopify.

Taxes are calculated and applied based on the province of your billing or shipping address, in accordance with Canadian tax laws. You are responsible for any applicable duties, customs fees, or additional charges if shipping outside standard areas.

Payment is required at the time of order placement. We do not offer payment plans or credit terms unless specified for wholesale accounts.

Shipping and Delivery

We ship within Canada only. Delivery is available within the Halifax Regional Municipality (HRM) area using courier services. For other areas in Canada, please contact us for further information, or you may arrange your own courier service. In such cases, we will prepare the order and hand it over to your designated agent or courier for pickup.

Shipping costs and estimated delivery times will be provided at checkout. We are not responsible for delays caused by couriers, weather, or other factors beyond our control. Perishable items may have restrictions on shipping distances to ensure freshness.

Delivery or pickup is available for wholesale and catering orders within the HRM area; inquire for other locations. Service area for catering includes Halifax and surrounding areas.

Cancellations, Returns, Refunds, and Exchanges

  • Cancellations: As outlined above, ordinary orders cannot be cancelled. Wholesale and catering orders may be cancelled within 24 hours, subject to a 50% charge.
  • Returns and Refunds: We do not accept returns on food items, as all our products are perishable bakery goods. Refunds are only issued if the wrong product is delivered (e.g., incorrect item instead of what was ordered). In such cases, please contact us within 24 hours of receipt with proof (e.g., photos). We will investigate and, if confirmed, provide a refund or replacement at our discretion. Refunds are processed to the original payment method.
  • Exchanges: We do not offer exchanges.

All refunds exclude shipping costs unless the error is solely our fault.

Product Warranties and Guarantees

Our goods are made fresh with high-quality ingredients. We guarantee the freshness and quality of our products at the time of delivery or pickup. However, due to the perishable nature of bakery items, we cannot guarantee quality after delivery if not stored properly. No other warranties, express or implied, are provided.

User Accounts

You may create an account on our website for easier ordering. When creating or using an account:

  • Provide accurate, current, and complete information.
  • Do not use fake names, fake addresses, or someone else's information without their consent.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts for violations of these Terms, including fraudulent activity.

Prohibited Activities

You agree not to:

  • Place fraudulent orders or use our services for illegal purposes.
  • Resell our products in a way that claims credit or misrepresentation (e.g., resellers cannot attribute our products as their own creation).
  • Misuse our website, including hacking, scraping, or introducing viruses.
  • Infringe on our intellectual property or that of others.
  • Submit false or misleading information, including in custom order notes.

Violation of these prohibitions may result in order cancellation, account termination, and legal action.

Intellectual Property

All content on our website, including recipes, images, text, logos, and designs, is owned by Bake Theory or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.

Our recipes are our proprietary intellectual property and may not be copied or used commercially.

Limitation of Liability

To the fullest extent permitted by law, Bake Theory, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claim shall not exceed the amount paid for the order in question.

We are not liable for allergic reactions or health issues arising from user-provided information or product consumption.

Force Majeure

We are not liable for delays or failures to perform due to events beyond our control, such as natural disasters, strikes, supply shortages, or pandemics.

Governing Law and Jurisdiction

These Terms are governed by the laws of Nova Scotia, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Nova Scotia, Canada.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full effect.
